Can you add this file or install path to be classified as a Zombie Install or is this considered a Zombie Install?

That's not a zombie. A zombie is part of a program left behind after an update. What's happenned here is that a copy of MSMXL3 has been included with the program. Microsoft only update the version in the system directory. If this needs updating you need to go to the program author and get an updated copy if there is one. It's not likely to be much of a vulnerability in any case.
